(1) The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure for releasing him on regular bail during trial in connection with Crime No. 125/2015 registered at Police Station Sirgitee, District Bilaspur for the offence punishable under Section 392/34 of the Indian Penal Code.

(2) Case of the prosecution, in brief, is that applicant along with two other co-accused persons is said to have robbed three mobile phones and 1,500/- from the complainant on 20.5.2015 ₹ and, thereby, committed the aforesaid offences.

(3) After hearing learned counsel for the parties and taking into consideration the facts & circumstances of the case; and considering the fact one mobile phone has been seized from the possession of the applicant; and the other material collected by the prosecution against the applicant; I am not inclined to release the applicant on bail. Thus, the bail application is rejected. Certified copy, as per rules.
