1. This is first bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No.134/2021 registered at Police Station Rajim, Distt. Gariyaband (C.G) for the offences punishable under Sections 294, 323, 324 & 329 of IPC.
2. As per the prosecution case, on 20.07.2020 a report was made by Basant Kumar Banjare that the applicant has demanded money to consume liquor and having denied, assault was made on him which caused fracture on his face.
3. Learned counsel for the applicant submits that the applicant was arrested on 20.07.2020 and was released on personal bond and subsequently when section 329 IPC was added he has again been arrested. Learned counsel submits that the applicant is in jail since 26.02.2021; charge sheet has been
field and no further investigation is necessary, therefore, the applicant may be enlarged on bail.
4. Per contra, learned State Counsel opposes the bail application and submits that the medical report would corroborate the fact that the complainant was assaulted.

Having considered the fact that earlier the applicant was arrested and released on personal bond and subsequently with the addition of section 329 IPC, he has again been arrested and further considering the fact that the charge sheet has been filed; no further investigation is necessary and the applicant is in jail since 26.02.2021, I am inclined to allow this bail application.
6. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court for his appearance before the said Court as and when directed.
