Sam Koshy Order On Board 15/03/201 This is the repeat bail application filed u/s 439 of Cr.P.C. for grant of bail to the applicant who is in jail since 03.09.2017 in connection with Crime No. 187/2017 registered at Police Station Ambagarh Chowki, District Rajnandgaon (CG) for the offence punishable under Sections 489 (A), (B), (C), (D), (E) of IPC.

The earlier bail application stood dismissed as withdrawn vide order dated 09.01.1018 in MCRC No. 7382/2017. The applicant now has filed the present bail application on the ground that two co-accused with identical charges have been granted bail by two co-ordinate Benches of this Court and prays for grant of bail on the ground of parity. 3.

Considering the fact that co-accused Vikram Singh in MCRC No. 8005/2017 and Ganesh Ram Jangade in MCRC No. 193/2018 have been granted bail by the two co-ordinate Benches of this Court vide order dated 28.02.2018 and 06.03.2018 respectively, this Court is of the opinion that the

present applicant is also entitled for similar treatment on the ground of parity and also taking note of the fact that he is in custody since 03.09.2017. 4.

Accordingly, the application for grant of bail is allowed. It is directed that the present Applicant will be released on bail on his furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court for his appearance before the said Court as and when directed.
