Agrawal Order On Board /07/2015 (1) The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure for releasing him on regular bail during trial in connection with Crime No.31/2015 registered at Police Station Kapu, District Raigarh for the offences punishable under Sections 363,366 & 376 of the Indian Penal Code and Section 4 of the Protection of Children from Sexual Offences Act, 2012. (2) Taking into consideration the facts & circumstances of the case and the manner in which applicant is said to have kidnapped and committed sexual intercourse with the prosecutrix, who is said to be minor on the date of offence; I am not inclined to release the applicant on bail.
