This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant, who has been arrested in connection with Crime No. 50/2015, registered at Police Station Utai, District Durg (C.G.), for the offence punishable under Sections 450, 307, 302 of Indian Penal Code.

Case of the prosecution, in brief, is that applicant is said to have burnt Khima Khunde on 21/02/2015, by which, she died. 3.

After hearing learned counsel appearing for the parties and taking into consideration the nature and gravity of offence; dying declaration of the deceased recorded on 22/02/2015 and manner, in which, applicant is said to have extended burn injury to the deceased, this Court is not inclined to release the applicant on regular bail.

Accordingly, bail application filed under Section 439 of the Cr.P.C. is rejected.
