NAFR HIGH COURT OF CHHATTISGARH, BILASPUR WPS No. 2826 of 2016 • Smt. Mamta Tirkey W/o Shri Manoj Kumar Bhagat, Aged About 30 Years R/o C- 34, Lok Manya Parisar, Goal Chowk, Rohani Puram, Raipur, Civil And Revenue District Raipur, (Chhattisgarh) ---- Petitioner

Versus

1. State Of Chhattisgarh Through: Secretary, Panchayat And Rural Development Department, Mahanadi Bhawan, Mantralaya, Capital Complex, New Raipur, District Raipur, (Chhattisgarh)

2. The Collector, Raipur, District Raipur, (Chhattisgarh)

3. Chief Executive Officer, Zila Panchayat, Raipur, District Raipur, (Chhattisgarh) ---- Respondents -------------------------------------------------------------------------------------------------- For Petitioner :

Mr. Dharmesh Shrivastava, Advocate For State /Respondents :

Mr. S.P. Kale, Dy. Advocate General -------------------------------------------------------------------------------------------------- Hon'ble Shri Justice Goutam Bhaduri Order On Board 13/07/2016 1.

The instant petition is preferred with a prayer to issue a direction to respondents to allow the petitioner to work at present place of posting i.e. Raipur as per order dated 25.05.2016. 2.

As per case of the petitioner, the petitioner after having transferred on 25.05.2016, she has been relieved from Jila Panchayat, Janjgir-Champa to Jila Panchayat, Raipur. However, the work has not been provided to her.

3.

Learned counsel for the petitioner would submit that though the petitioner has joined at the place of posting, no work is provided to her.

4.

It is prerogative of the State to get work from the employee and the nature of work to be discharged by an employee is to be decided by the employer. The employee is not entitled, as a matter of right, to ask the Government that they should be given any particular work.

5.

In view of the above prayer appears to be misconceived. This Court is of the opinion that no writ in the like nature can be issued at present.

6.

Accordingly, the instant petition is dismissed. Sd/- (Goutam Bhaduri) Judge Chandra
