This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant, who has been arrested in connection with Crime No. 132/13, registered at Police Station Khadgawa, for the offence punishable under Section 376 of Indian Penal Code.

After hearing learned counsel appearing for the parties and taking into consideration the material collected by the prosecution and further considering the fact that out of 18 listed witnesses, 7 witnesses including prosecutrix and her father have been examined, this Court is not inclined to release the applicant on regular bail.

Accordingly, bail application filed under Section 439 of the Cr.P.C. is rejected. However, the trial Court concerned is directed to expedite the trial and decide the case as early as possible preferably within a period of 3 months from the date of receipt of certified copy of this order. 4.
