1. The appellant has filed this appeal against the judgment of conviction and order of sentence dated 17.01.2019 rendered by Session Judge, Kabirdham (Kawardha) C.G. in S.T. No.46/2017 whereby and whereunder the appellant has been convicted under Section 302 of the I.P.C. and sentenced him to undergo life imprisonment.

2. The report has been received from the Superintendent of Central Jail, Raipur informing that sole appellant - Mahesh Nut son of Fool Singh Nut has died on 04.07.2020.

3. The legal heirs/ dependants of the sole appellant have not moved any application seeking permission to prosecute the appeal.

4. In the above circumstances, the instant appeal is dismissed as abated.
