This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicants, who have been arrested in connection with Crime No. 238/2014, registered at Police Station City Kotwali, Distt. Baloda Bazar (C.G.), for the offence punishable under Section 394/34 of Indian Penal Code. 2.

Case of the prosecution, in brief, is that applicants are said to have robbed the motorcycle owned by complainant on 25/05/2014 and thereby committed offence.

After hearing learned counsel appearing for the parties and taking into consideration the recovery of robbed motorcycle from applicant No1Harishankar Sahu and considering the criminal antecedent of applicant No. 2-Ravi Malik, this Court is not inclined to release the applicants on regular

bail.

Accordingly, bail application filed under Section 439 of the Cr.P.C. is rejected.
