This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant, who has been arrested in connection with Crime No. 727/2014, registered at Police Station Civil Line, Raipur, District Raipur (C.G.), for the offence punishable under Sections 454 & 380 of Indian Penal Code. 2.
Case of the prosecution, in brief, is that applicant is said to have stolen gold and silver ornaments from the house of complainant-Basant Sahu in the intervening night of 09-10/11/2014.

After hearing learned counsel appearing for the parties and taking into consideration the nature and gravity of offence; material collected by the prosecution and in view of the seizure of the ornaments from the possession of the applicant and co-accused, this Court is not inclined to release the applicant on regular bail.

Accordingly, bail application filed under Section 439 of the Cr.P.C. is rejected.
