No doubt the delay in this case is of more than two years. Learned Counsel for the Petitioner fairly submits that the mistake is on his part. According to him, he could not see the cause-list, therefore, the case was dismissed for want or prosecution.

It is well settled law that the client should not suffer for the fault of his Counsel.

In view of the above, M.C.C. is allowed and Writ Appeal No.210 of 2013 is restored to its original file.
