Learned counsel for the appellant would submit that as per the Registry there is no delay in filing the CRMP, therefore, he may be permitted to withdraw I.A. praying for condonation of delay.

Accordingly, the application for condonation of delay is dismissed as not pressed.

CRMP No.237/16 filed by the State challenging the judgment of acquittal which is appealed in this petition also has been allowed on 21-4-16 and thereafter acquittal appeal No.41/16 has been registered.

In view of the above, the present application seeking leave to appeal is allowed. Let regular acquittal appeal be registered and notices therein be issued to the respondents on payment of process fee as per rules.

Thereafter, post the acquittal appeal for hearing in due course.

Name of learned Advocate General be mentioned in the cause-list on further dates of hearing.
