1. This is first bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicants in Crime No.04/2021 of Police Station Partapur, Distt. Kanker (C.G) for the offence punishable under Section 20(B) of the Narcotic Drugs and Psychotropic Substances Act.

2. As per the prosecution case, on a raid being conducted on 12.02.2021 from the possession of the applicants, 17.130 Kgs. of Ganja was recovered from the offending vehicle No.MH-12-LD/3324 and the applicants were the travelling in the Car, thereby the offence has been committed.

3. Learned counsel for the applicant submits that the bail of co-

accused Ashutosh Gedam has been granted by the Coordinate Bench of this Court in M.Cr.C.No.1908/2021 on 28.06.2021 and the case of the present applicants is also on similar footing. He further submits that the applicants are in jail since 12.02.2021; charge sheet has been filed and no further investigation is necessary, therefore, the applicants may be enlarged on abil.

4. Per contra, learned State Counsel opposes the bail application.

Considering the quantity of cannabis seized and the facts that the applicants were occupants of the Car and they are in jail since 12.02.2021 as also the fact that the other accused Ashutosh Gedam has been enlarged on bail by the coordinate bench of this Court, I am inclined to allow this bail application.

6. Accordingly, the bail application is allowed and the applicants are directed to be released on bail on each of them executing a personal bond in sum of Rs.25,000/- with one surety each in the like sum to the satisfaction of the concerned trial Court for their appearance before the said Court as and when directed.
