The Petitioner was dismissed from service on 17.10.2002 affirmed by the Appellate Authority on 29.9.2003. The allegations related to financial embezzlement. The writ petition was then filed three years later in 2006. 2.

In matters relating to dismissal from service there is always an urgency as the vacancy does not remain and is filled up by the next incumbent creating third party rights. The counter affidavit opposes on grounds of delay and laches as also that there is no infirmity in the decision making process warranting interference with the order of punishment passed in a departmental proceeding. 3.

The writ petition is dismissed.
