This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant, who has been arrested in connection with Crime No.49/2015, registered at Police Chowki Rampur, P.S. City Kotwali, Distt. Korba (C.G.), for the offence punishable under Section 302 of I.P.C.

After hearing learned counsel appearing for the parties and taking into consideration the manner, in which, applicant is alleged to have caused murder of deceased-Santosh by knife; blood stained full-pant has been recovered from the possession of applicant and considering the testimony of two eyewitnesses, namely, Amit Rathiya and Dhanidas, this Court is not inclined to release the applicant on regular bail.

Accordingly, bail application filed under Section 439 of the Cr.P.C. is rejected.
