Drugs is appealable before the State Government under Rule 66(2) of the Drugs and Cosmetics Rules, 1945.
(2) In view of above, learned counsel appearing for the petitioner would submits that he may be permitted to prefer appeal before the appellate authority for redressal of his grievances.
(3) Accordingly, the petitioner is directed to prefer appeal before the appellate authority within a period of 10 days from today and, in turn, the appellate authority would do well to decide the same expeditiously preferably within a period of 45 days from the date of receipt of certified copy of this order after affording due opportunity of hearing to both the parties. (4) With the aforesaid observations, the writ petition stands finally disposed of.
