Hon'ble Shri Justice Gautam Chourdiya Judgment On Board 08/11/2021 1) This appeal is filed under Section 374(2) of Code of Criminal Procedure, 1973 against the judgment of conviction and order of sentence dated 30/10/2003 passed by Special Judge (NDPS) Rajnandgaon, District Rajnandgaon (C.G.) in Special Case No. 72/2003; whereby the appellant stands convicted and sentenced as under:- Conviction Sentence Under Section 20(b)(i) of Narcotic Drugs and Psychotropic Substances Act.

R.I. for 10 years and fine of Rs. 1,00,000/-, in default of payment of fine 02 years R.I.

2) As per office note, bailable warrant against the appellant returned unserved with the report that the sole appellant has died on 28/10/2020. Copy of the Death Certificate is also available on record confirming the fact that the appellant died on 28/10/2020.

3) No application has been filed by the legal heirs of the appellant for prosecuting this appeal till date.

4) In these circumstances, the present appeal stands abated and is dismissed as such.
