This petition under Article 226 of the Constitution of India is preferred seeking direction to the respondents to consider petitioner's application for grant of compassionate appointment.

Learned counsel for the petitioner would submit that although the application for grant of compassionate appointment preferred by the petitioner on account of death of her father on 18/03/2013 is pending, yet this petition has been preferred because more than two years have elapsed after moving the application and the petitioner apprehends that on expiry of period of three years, the petitioner may be denied appointment on the ground that such application cannot be considered after three years.

Considering the entire fact situation of the case, the writ petition is disposed of directing the respondent No. 2 to consider and decide petitioner's application for grant of compassionate appointment, on its own merits, in accordance with law at the earliest and preferably within a period of three months from the date of submission of certified copy ofthis order. 4.

It is made clear that this Court has not expressed any opinion on the merits of the case and the respondent-authorities shall decide the matter, on its own merits, strictly in accordance with law, without treating any observation madein this order, as opinion on the merits ofthe case.
