This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicants who have been arrested in connection with Criminal Case No.90/2015 pending before the Chief Judicial Magistrate, Balrampur-Ramanujganj (CG), for the offence punishable under Sections 468, 471, 205 and 120B of the IPC. 2.
Case of the prosecution, in brief, is that in pending appeal against accused Rakumar Gupta, applicant No.2, applicant No.1 Jetan Singh impersonated himself as complainant Lallu Yadav and filed an application for compromise before the Chief Judicial Magistrate, Balrampur-Ramanujganj and thereby committed the aforesaid offence.

Learned counsel for the applicants would submit that the applicants
are villagers and they have not committed any offence. Leaned counsel would submit that they are in jail since 2.6.2015. 4.
Learned State counsel would oppose the prayer for grant of bail. 5.
I have heard learned counsel appearing for the parties. 6.
Taking into consideration the facts and circumstances of the case; further taking into consideration the nature and gravity of offence and the manner in which the applicant No.1 impersonated himself as complainant Lallu Yadav to get the applicant No.2 acquitted from the criminal charges, this Court is not inclined to release the applicant on regular bail. 7.
Accordingly, bail application filed under Section 439 of the Cr.P.C. is rejected.
