Agrawal Order On Board 11/09/2017 (1) Learned counsel appearing for the petitioner would submit that the Naib Tahsildar, Bemetara has passed the impugned order dated 09.08.2017 by which the construction of commercial complex at Padkideeh was stayed, which is unsustainable and bad-in-law. (2) Learned counsel appearing for the State would submit that the petitioner is a Sarpanch of Gram Panchayat Marka, Janpad Panchayat, Bemetara and he is illegally encroaching the subject land, which is earmarked land for hospital purpose. (3) I have heard learned counsel for the parties and perused the impugned order.

(4) Be that as it may, the Collector, Bemetara is directed to do well and take a decision on the case of the petitioner, strictly in accordance with law expeditiously from the date of receipt of copy of this order. (5) With the aforesaid observation, the writ petition stands finally disposed of.
