Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 27/10/2017 This Court had earlier examined the records in view of the allegations that the transfer order is antedated. In this regard, order has also been passed by this Court on the last date of hearing.

The second ground raised to challenge the order is that the number contained in order dated 14/08/2017 (Annexure P/1) transferring the petitioner and another order dated 14/08/2017 bears the same number. Once this Court has examined the original records and the allegations of antedating is not found substantiated, this ground would only be a technical aspect and cannot be made a ground to challenge the transfer order.

The last ground is the illness of the petitioner. It is submitted that the petitioner is suffering from heart ailments and she requires regular check up, particularly in the hospital of Bhilai Steel Plant. It is submitted that if the petitioner is transferred to a place which is 45 kms away, she will face serious difficulties in taking regular check

up.

This would be a matter of consideration for the administrative authority and not for the Court as this does not relate to any illegality. Therefore, this petition is dismissed with liberty to the petitioner to file representation and if representation is filed, the same shall be considered and decided within four weeks from the date of receipt of representation.
