Hon'ble Shri Justice Gautam Chourdiya Judgment on Board 13.08.2021

1) The appellant has preferred this appeal under Section 14 (A) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 as the appellant was arrested in connection with Crime No. 515/2020 for the offence punishable under Sections 302, 120-B, 201/34 of IPC and Sections 3 (2-v) of SC/ST Act registered at Police StationAJK Surajpur, District- Surajpur (C.G.).

2) After arguing for sometime, learned counsel appearing for the appellant seeks to withdraw this Criminal Appeal with liberty to file afresh as and when occasion arises.

3) Wife of the deceased namely Nira has appeared through

video conferencing mode from District Legal Services Authority, Surajpur and raised objection to grant of bail to the appellant.

4) Counsel for the State has no objection to the above prayer.

5) Permission granted.

6) Accordingly, the Criminal Appeal is dismissed as withdrawn with the liberty as stated above.
