Mr. Madhunisha Singh, Panel Lawyer, for the State. This is first bail application filed u/s 439 of the Code of Criminal Procedure for grant of bail to the applicant in connection with Crime No.80/2017 registered at Police Station Ranchirai, Distt. Balod (C.G) for the offence punishable u/s 307 & 341 of IPC.

As per the prosecution case, a report was made by victim Arjun Singh Sahu that a dispute arose between him and applicant on additional payment of sale consideration of paddy on which the applicant has assaulted the victim by way of Axe as a result of which the victim sustained grievous injury which was sufficient to cause death. Learned counsel for the applicant would submit that there was no intention to cause death and the injuries were not to the extent that would take away the life. He further submits that the charge sheet has been filed; no further investigation is necessary and the applicant is in jail since 22.10.2017, therefore, he may be enlarged on bail.

Per contra, learned State Counsel opposes the bail application.

Perused the statement of victim Arjun Singh Sahu and the medical report. Considering the same, I am not inclined to allow this bail application. Accordingly, it is rejected.
