1. Proceedings of this matter have been taken-up through video conferencing.

2. Mrs. Astha Shukla, learned counsel appearing for the petitioner, would submit that the petitioner's representations dated 14-12-2004, 30-122004 and 19-4-2010 for seniority have been rejected by the State Government vide order dated 30-9-2010 (Annexure P-8) by a nonspeaking and unreasoned order by which he has suffered prejudice, therefore, he may be allowed to file fresh representation before the State Government.

3. The prayer is fair and reasonable.

4. The petitioner is permitted to file fresh representation before the State

Government qua seniority within three weeks from today and the State Government will decide the same by a speaking and reasoned order within 30 days from the date of receipt of the said representation without being prejudiced by order dated 30-9-2010 (Annexure P-8). This Court has not expressed any opinion on the merits of the matter.
