Appellant Gopi Kishan @ Gopi has already assailed the impugned judgment of conviction in Criminal Appeal No.1720/2017 and the said Appeal was filed on 6.11.2017 whereas, the present Appeal assailing the same judgment has been filed subsequently on 5.3.2018.

In view of the fact that two Appeals have been filed assailing the same judgment, the present Appeal which has been filed subsequently, is not maintainable.

Shri Jain, learned Counsel, who has been appointed through High Court Legal Services Committee is however permitted to file his memo in Criminal Appeal No.1720/2017. Shri Sahu, learned Counsel appearing in Criminal Appeal No.1720/2017 has no objection to this.
