Hon'ble Shri Justice Sanjay K. Agrawal Order On Board 13/07/2015 Heard.

(1) The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure for releasing him on regular bail during trial in connection with Crime No. 49/2015 registered at Police Station -Chakradhar Nagar, Raigarh, District Raigarh for the offences punishable under Sections 420, 467,468 & 471 of the Indian Penal Code (as per charge sheet).

(2) Case of the prosecution, in brief, is that the applicant was found running the Paramedical course without being registered by C.G.

Paramedical Board and issued forged mark sheets/certificates of the said course and, thereby, committed the aforesaid offences. (3) Counsel for the applicant submits that the applicant has not committed any offence and he has falsely been implicated in the crime in question as it is the recognized institution of paramedical course. He further submits that applicant is in jail since 24.04.02015; and the charge sheet has already been filed and, therefore, the applicant may be released on bail.

(4) On the other hand, counsel for the State submits that it is fake institution; not duly recognized by C.G. Paramedical Board; and the applicant is involved in running the said Institution without registration and issued fake & forged certificates.

(5) Taking into consideration the facts & circumstances of the case; considering the material collected by the prosecution against the applicant; and the manner in which Paramedical Institution was found running without registration; I am not inclined to release the applicant on bail. Therefore, the bail application is rejected. Certified copy, as per rules.
