The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.32/2016 registered in Police Station Khadgawan, District Koriya (C.G.) for offence punishable under sections 420, 34 of Indian Penal Code.

As per the prosecution case, in between 9/02/2016 to 11/02/2016 the applicant alongwith other co-accused at village Chirmi were vaccinating for Hepatitis-B and were charging Rs.50/- from the villagers without permission of the Health Department.

Learned counsel for the applicant submits that the applicant is the daily wager employee of Research India and Research India which is NGO was administering Hepatitis-B injection and injection which was administered was not fake and permission was obtained from the District Medical Officer, therefore no offence is made out and the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.

Perused the case diary and the documents. Charge sheet in this

case has been filed. Taking into facts of this case and the documents, this court is inclined to release the applicant on bail. 6.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
