Agrawal Order On Board 11/09/2017 (1) Learned counsel appearing for the petitioner would submit that the learned Commissioner, Surguja by its order dated 29.08.2017 has refused to extend the stay order dated 07.01.2017 as extended on
27.03.2017 and 16.05.2017 and fixed the case for final hearing on 11.09.2017 and the letter dated 14.08.2017 has been issued to complete the entire exercise.
(2) Learned counsel for the State would support the impugned order and oppose the prayer made by the learned counsel for the petitioner. (3) I have heard learned counsel for the parties and perused the impugned order.
(4) Since the matter is fixed for final hearing on 11.09.2017 and stay order passed on 07.01.2017 was operating till 16.05.2017, therefore, in the interest of justice, it would be expedient to direct the Commissioner, Surguja to hear the matter and pass the final order on or before 30.09.2017. Till then, the stay order passed on 07.01.2017 shall remain in operation.
(5) With the aforesaid observation, the writ petition stands finally disposed of.
