Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 16/01/2018 The petitioner filed this petition in the year 2003 for issuance of direction for payment of leave encashment benefits with Dearness Allowance as also for payment of Provident Fund.

In the return, it has been averred that in so far as leave encashment benefits are concerned, 225 days of earned leave has been allowed for encashment for an amount of Rs.71,243/-. It has also been averred that the amount was offered to the

petitioner at home but the petitioner was not found. In so far as non-payment of GPF amount is concerned, in the return, it has been stated that petitioner's case was forwarded to the office of the Accountant General as several entries of Part Final were to be settled in the pass book of provident fund. It has also been averred that order dated 14/07/2003 of this Court reflects that learned counsel for the petitioner was granted time to verify regarding receipt of cheques. Thereafter, no affidavit has been filed in the matter from the side of the petitioner.

In these circumstances and at this distance of time, when there is no representation made on behalf of the petitioner, this petition is dismissed though with liberty to revive, in case, any amount still remains unpaid. Sd/- (Manindra Mohan Shrivastava) Judge Deepti
