Shri Sangharsh Pandey, Dy.GA Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 09/08/2016 This petition has been filed by the petitioner seeking direction for supply of documents needed for his defence in the pending departmental enquiry. This is third round of litigation.

Learned counsel for the petitioner submits that though the petitioner has submitted a list of as many as 84 documents for inspection and supply of copies, these documents are not being supplied, presumably on the ground that the documents are not traceable and no orders have been passed. Learned counsel for the petitioner has drawn attention of this Court to order dated 02-12-2015 (Annexure P-3) passed by the State Government, by which, the Chief Municipal Officer has been directed to allow inspection and supply of necessary documents to the petitioner and to take action against those officers and employees responsible for documents being misplaced.

In view of the order of the State Government, the documents which have been sought by the petitioner, should be allowed for inspection to the petitioner. If the documents have been misplaced, in such cases, the competent authority may take action against the persons, who are responsible for loss of documents. Whatever documents are available should be allowed to be inspected by the petitioner and thereafter, inquiry should proceed in the matter without delay and without granting unnecessary adjournments to any of the parties. 4.
