NAFR HIGH COURT OF CHHATTISGARH AT BILASPUR WRIT PETITION (C) NO. 877 OF 2020 • Gulabchand Jamoria, S/o Shri K.N. Jamoria, aged about 51 years, R/o Rajkishore Nagar, Bilaspur (CG) ... Petitioner versus 1.

State of Chhattisgarh, through the Collector, Bilaspur, District Bilaspur (CG) 2.

The Additional Registrar (Administration), High Court of Chhattisgarh, Bodri, Bilaspur (CG) ... Respondents For Petitioner :

Mr. P. Acharya, Advocate, under instructions of Mr. Abhyuday Singh, Adv.

For Respondent No.1 :

Mr. Jitendra Pali, Dy. Advocate General.

Hon'ble Shri Justice P. Sam Koshy Order on Board /03/2020 1.

The limited relief that the Petitioner has sought for through the present Writ Petition is for a direction to Respondent No.1 for grant of possession of the vacant house, i.e., Qtr. No. G-1, situated at Warehouse Road, Bilaspur. 2.

According to the learned Counsel for the Petitioner, the said quarter was alloted to the Petitioner vide order dated 5.1.2019 (Annexure P-2). However, when the Petitioner on the basis of the said allotment order had gone to take possession of the said quarter, he found that there are more than couple of locks put on the said quarter and therefore he was unable to take possession of the same.

3.

Given the facts and circumstances of the case, particularly taking note of the order of allotment dated 5.1.2019, this Court is of the opinion that ends of justice would meet if the present Writ Petition is disposed of with a direction to Respondent No.1 to ensure grant of possession of the said quarter to the Petitioner in terms of the order dated 5.1.2019, unless the said order has since been modified, cancelled or amended at a later stage. Let appropriate steps be taken by Respondent No.1 at the earliest, preferably within a period of 45 days from the date of presentation of certified copy of this order by the Petitioner. 4.

With the aforesaid direction, the Writ Petition stands disposed of. Sd/- (P. Sam Koshy) /sharad/ JUDGE
