Hon'ble Shri Justice Sanjay K. Agrawal Order On Board 25/09/17 Learned counsel for the petitioner would submit that the show cause notice dated 01.07.2017 has been issued by the respondent No. 02Municipal Corporation, Raipur to the petitioner for removing the encroachment without taking measurement in presence of the petitioner and as such the impugned notice is unsustainable and bad in law. 2.
Learned counsel appearing on behalf of the State would submit that the petitioner may file a reply to the notice and if necessary the measurement will be done in presence of the petitioner. 3.
I have heard learned counsel for the parties.

Be that as it may, in view of the aforesaid submission made by the learned State counsel, the petitioner may file reply to the respondent No. 2Municipal Corporation, Raipur who, in turn, shall consider and decide the petitioner's case expeditiously.

With the aforesaid observation, the writ petition stands finally disposed of.
