Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 25/07/2016 Transfer order has been challenged mainly on the ground that the petitioner has been subjected to transfer when he has less than one year left for his retirement from service.

Reliance has been placed on Clause 2.10 of Transfer Policy dated 11/06/2016, according to which, a Government servant, who has less than one year of service left, may be transferred either to his home district or to a place of his option.

The aforesaid ground requires consideration by the competent authority. It is found that the petitioner has filed this petition without preferring any representation. Accordingly, this petition is disposed off with a direction to the

respondent authorities that if the petitioner prefers representation within a period of 10 days from today, the State Government shall consider his representation in the light of its own policy, subject to administrative exigency and public interest. The decision should be taken within a period of three weeks from the date of receipt of representation.

For a period of four weeks, no coercive steps shall be taken against the petitioner.
