(2) This is the second bail application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with Crime No.240/2015 registered at Police Station Patharia, District Mungeli, for the offence punishable under Sections 147, 148, 149, 302/201 of Indian Penal Code.

(3) The applicant's first bail application was dismissed as withdrawn by order of this Court dated 01.03.2016 passed in

M.Cr.C. No.833/2016.

(4) After hearing learned counsel appearing for the parties and taking into consideration the facts and circumstances of the case, I do not consider it a fit case to entertain this second bail application. Consequently, the second bail application is dismissed as having no merits in view of this Court order dated 01.03.2016. However, the trial Court is directed to furnish an explanation as to why trial has not been concluded till now as directed by order dated 01.03.2016. The report along with explanation must be reached before this Court latest by 19th August, 2016.
