It is the grievance of the petitioner that petitioner's representation for staying execution of partition proceedings which was forwarded by the Commissioner to the Collector has remained pending.
Learned counsel for the petitioner submits that Gram Panchayat directed partition of holding in which the petitioner has interest. The petitioner has filed representation before the the Commissioner, who, in turn, directed the Collector to examine the matter. But, till date, no order has been passed.
On petitioner's own showing, the partition order has been passed by the Gram Panchayat. There is nothing on record to show that the petitioner has instituted any proceedings before the competent authority under the law to challenge the order of Gram Panchayat. However, as the Commissioner has forwarded petitioner's representation to the Collector to examine the same, this Court, without issuing any specific direction, leaves it for the Collector to examine the petitioner's representation and take decision thereon in accordance with law.
