Agrawal Order On Board 19/09/2017 (1) Learned counsel appearing for the petitioner would submit that the writ petition being WP(C) No.1693/2017 filed by the petitioner before this Court. This Court by order dated 23.06.2017 dismissed the petition with a liberty to file an appeal against the order of Tahsildar under Section 248 of the Chhattisgarh Land Revenue Code before the concerned Sub Divisional Officer and further directed to the respondent authorities to allot the land to the petitioner under

rehabilitation policy. Thereafter, the petitioner has preferred an appeal under Section 248 of the Chhattisgarh Land Revenue Code along with stay application before the Sub Divisional Officer, Ramanujganj, which is still pending and without considering the same the house in question was demolished, which is unsustainable and bad-in-law. (2) I have heard learned counsel for the parties. (3) Since the appeal is pending consideration before the Sub Divisional Officer, Ramanujganj, therefore this Court is not inclined to entertain the instant writ petition. However, the petitioner is at liberty to pursue the appeal and depending upon the result of the appeal he may proceed further. However, the Sub Divisional Officer, Ramanujganj is directed to consider and decide the appeal, expeditiously.

(4) With the aforesaid observation, the writ petition stands finally disposed of.
