This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant, who has been arrested in connection with Crime No.14/2015, registered at Police Station Arjuni, District Dhamtari (C.G.), for the offence punishable under Sections 379, 411/34 of Indian Penal Code.

Case of the prosecution, in brief, is that, applicant is found in possession of the stolen property i.e. gold ornaments owned by Godawari Bai and thereby committed offence.

After hearing learned counsel appearing for the parties and taking into consideration the seizure of the stolen ornaments from the possession of applicant, this Court is not inclined to release the applicant on regular bail.

Accordingly, bail application filed under Section 439 of the Cr.P.C. is rejected.
