1. Late Anand Kumar Awasthi filed this writ petition claiming promotion at par with respondents No.3 and 4. During the pendency of writ petition, the original petitioner died in harness on 6-8-2005 and his legal representative Smt. Suniti Awasthi being wife, was brought on record.

2. It is stated at the Bar that Smt. Suniti Awasthi has now already been given compassionate appointment by the State Government and she is continuing on the said post. Since the original petitioner died and his legal representative has already been given compassionate appointment, I deem it expedient to close this case, at this stage, leaving the contentions open.

3. With the aforesaid observation, the writ petition stands finally disposed of. No order as to cost(s).
