1. Heard.

2. This is the First Bail Application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested on 26.01.2021 in connection with Crime No.52/2021 registered at Police Station O.P. Surgi, Police Station Basantpur, District Rajnandgaon (CG) for the offence punishable under Section 34 (2) of the C.G. Excise Act, 2015.

3. As per the prosecution case, on a raid being conducted on 26.01.2021 by the police from the farmhouse 1755 bulk liter of liquor was seized from the joint possession of the applicant and others.

4. Learned counsel for the applicant submits that the farm house from which the

seizure is made belongs to one Jitendra Pandit and the applicant was only working there, therefore, the applicant may be released on bail.

5. Per contra, learned State counsel opposes the prayer for grant of bail.

6. Considering the nature of allegation and the quantity of liquor of 1755 bulk liter which was seized from the joint possession of the applicant and the other , I am not inclined to release the applicant on bail.
