(1) The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure for releasing him on regular bail during trial in connection with Crime No. 20/2011 registered at Police Station - Chhawani, Distt. Durg for the offences punishable under Sections 365, 302 & 386 of the Indian Penal Code.

(2) Taking into consideration the facts & circumstances of the case and the manner in which the applicant is alleged to have

kidnapped & strangulated deceased - Stayjeet Khahar, aged about 10 years; and the other material collected by the prosecution; I am not inclined to release the applicant on bail. Thus bail application is rejected.
