1. The present writ petition has been filed by the petitioner against the prolonged departmental inquiry which was initiated against him in the year 2016.

2. Today, when the matter is taken up for hearing, learned counsel for the petitioner submits that the petitioner has since expired in the month of

March, 2021.

3. In view of the submission by the counsel for the petitioner that the petitioner has expired, the writ petition at this juncture stands abated. However, it is observed that since the departmental inquiry was not concluded, the legal heirs would be entitled for the death-cum-retiral benefits payable to the family members in accordance with law.

4. It is also observed that the respondents shall make all endeavours in settlement of the death-cum-retiral benefits payable to the family members of the petitioner at the earliest. In case there is any further dispute so far as the amount of retiral dues and other benefits payable and receivable to the family members of the deceased petitioner are concerned, the family members would have liberty for approaching this Court by way of a fresh writ petition.
