1. Heard.
2. This is the First Bail Application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested on 06.02.2021 in connection with Crime No. 21/2021 registered at Police Station Urla, District Raipur (CG) for the offence punishable under Sections 294, 323, 34, 452, 506, 324 of Indian Penal Code.
3. As per the prosecution case, on 21.01.2021 the present applicant along with the other co-accused entered into the house of the complainant namely Manisha Sahu, abused her and was quarreling with her. At that time one
Devendra Pandey, who was also a vegetable vendor, entered to solve the dispute he was also assaulted and the assault was also made to one Raju Sao, who also tried to intervene. During such altercation/quarrel Devendra Pandey sustained stab injury on his chest part.

Learned counsel for the applicant submits that the applicant is in jail since 06.02.2021 and the incident happened for the reason that the applicant wanted to solve certain altercation which was going in the house of the complainant Manisha Sahu. He would further submit that the charge-sheet in this case has been filed and no further investigation would be required, therefore, the applicant may be released on bail.
5. Per contra, learned State counsel opposes the prayer for grant of bail and read out the statement of the complainant.
6. Considering the statement, nature of injury and also the fact that the chargesheet in this case has been filed and the applicant is in jail since 06.02.2021 and no further investigation would be required, I am inclined to release the applicant on bail.
7. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court. SD/Sd/- Goutam Bhaduri Judge Ashu
