Versus
1. State of Chhattisgarh Through the Secretary, Department of Revenue & Disaster Management, Mantralaya, Mahanadi Bhawan, Naya Raipur, District Raipur.
2. Commissioner, Directorate Land Records, Indravati Bhawan, First Floor, Block-2, Naya Raipur, District Raipur, (Chhattisgarh)
3. Collector Raipur, P.S. Civil Lines, District Raipur, (Chhattisgarh) ---Respondents For Petitioner : Mr. Jitendra Pali, Advocate For Respondents/State : Mr. Raj Kumar Gupta, Dy. Advocate General Hon'ble Shri Justice Manindra Mohan Shrivastava Order on Board 27/07/2016 Heard on admission.
1.
The challenge is to transfer order dated 21/07/2016 made mainly on the ground that the transfer order wrongly records the place of petitioner's posting at Kharora, District Raipur, whereas the Collector vide order dated 12/07/2016, posted the petitioner in Nazul Branch at Raipur. The other ground is that the petitioner is suffering from ailment due to stone in the Kidney and for that he is required to proper treatment. 2.
As far as first ground is concerned, it is too technical and it is for the State Government to consider this aspect. However, the fact is that the petitioner remained posted at Raipur District throughout. Upon promotion in
the year 2016, he was sent to Tilda but soon thereafter, he was brought back to Raipur. By the impugned order, he has been sent to Kondagaon. The service of the petitioner is transferable in nature, therefore, he could be transferred anywhere.
3.
As far as medical ground is concerned, if the petitioner makes a representation to competent authority, the competent authority shall consider and decide his representation within a period of three weeks' from the date of submission of representation.
4.
With the aforesaid observation, the petition is disposed off. Sd/- (Manindra Mohan Shrivastava) Judge Tiwari
