1. Proceedings of this matter have been taken up through video conferencing.

2. This is the first bail application for grant of regular bail to the applicant, who has been arrested in connection with crime No. 06/2020 registered at police station Patna, District Koriya, C.G. for offence punishable under Section 20-B of the NDPS Act.

3. The case of the prosecution, in brief, is that 14.300 kgs of ganja was seized from the possession

of the present applicant, thereby, he committed the aforesaid offence.

4. Mr. Anil Gulati, learned counsel for the applicant, submits that the present applicant has not committed any crime and he has been falsely implicated in the crime in question. He is in custody since 03/01/2020.

5. On the other hand, learned counsel for the State opposes the bail application.

6. I have heard learned counsel appearing for the parties and perused the case diary.

7. Taking into consideration the nature and gravity of the offence and looking to the fact that though the quantity of ganja seized from the applicant is lesser than commercial quantity, but since it is 14.300 kgs, I do not consider it a fit case to grant bail to the present applicant.

8. Accordingly, the bail application filed under Section 439 of the Cr.P.C. is rejected.
