The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.161/2016 registered in Police Station Dharsiva Dist: Raipur (C.G.) for offence punishable under section 34 (2) of Excise Act.

As per the prosecution case, on 18/05/2016 on an information received that the applicant is selling illicit liquor, on raid being made from the possession of the applicant 9 bulk liters of illicit liquor was seized. 3.
Learned counsel for the applicant submits that the applicant has been falsely implicated in the case, no evidence is available against the applicant. Therefore, learned counsel submits that the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail and would submit that from 2001 to 2016, 22 criminal cases are to the credit of the applicant and out of which 5 cases are of IPC and other cases are under Cr.P.C.

Perused the case diary. Considering the facts and circumstances of
the case, the past antecedent and recovery made from the applicant, also considering the fact that 22 cases are to the credit of the applicant, this court is not inclined to release the applicant on bail. 6.
