3. Assistant Executive Officer, ( Finance ) Office Of Rajeev Gandhi Shiksha Mission, Ambikapur District Surguja Chhattisgarh ---- Respondents For Petitioner :

Mr. Varunendra Mishra, Advocate.

For Respondent-State :

Mr. Gary Mukhopadhyay, Dy. G.A.

S.B.:

Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 01/08/2016 Heard on admission.

The petitioner has filed this petition seeking a direction for his reinstatement on the ground that after his acquittal of criminal charges, the petitioner is entitled for reinstatement in service. 2.

It is the case of the petitioner, itself, that the petitioner was appointed on contract basis for a period of one year in the year 1995. It appears that because of certain criminal charges, he was discontinued from service. The period of contractual appointment came to an end automatically, after expiry of contractual period. After about 19 years, the criminal proceeding ended in acquittal. However, as the appointment of the petitioner was contractual one

-2only, no relief can be granted to reinstate the petitioner in service because even if the petitioner would have not been subjected to criminal proceeding, his contract appointment would have come to an end in the year 1995 itself. 3.

In view of the above, the petition has no merit and is therefore dismissed.
