1. The present contempt petition has been filed alleging non compliance of the interim order passed by this Court on 12.02.2021 in WPS No. 604 of 2021.

2. This Court while entertaining the writ petition as an interim measure on 12.02.2021 has ordered the authorities to maintain status quo in respect of the enquiry initiated against the petitioner.

3. The grievance of the petitioner now is that though there is an order of status quo by this Court, the enquiry agency has subsequently issued couple of notices directing the petitioner to appear and participate in the departmental enquiry, thus amounting to committing contempt of the order passed by this Court.

4. Perusal of records shows that the interim order passed by this Court on 12.02.2021 does not seem to have personally intimated to the Enquiry Officer

or at least such document is not available with the contempt petition. Learned counsel for the petitioner submits that as per the latest notice issued by the Enquiry Officer the next date of appearance is tomorrow i.e. 26.03.2021.

Considering the said submission and the material available on record, at this juncture, this Court is of the opinion that it would be appropriate for the petitioner to appear before the Enquiry Officer tomorrow i.e. on 26.03.2021 and to submit the order dated 12.02.2021 passed by this Court in WPS No. 604 of 2021 which is to maintain status quo of the departmental enquiry and request the Enquiry Officer that the departmental enquiry be kept in abeyance till further order is passed by this Court in WPS No. 604 of 2021.

With the aforesaid direction, the present contempt petition at this juncture stands disposed off directing the petitioner to appear before the Enquiry Officer and personally serving the order dated 12.02.2021 passed in WPS No. 604 of 2021 by this Court reserving the right of the petitioner to approach this Court in case it seems to arise in latter stage.

7. Accordingly, the contempt petition stands disposed off.
