This is first bail application under Section 439 of the Cr.P.C. preferred by the applicants before this Court and no other bail application is pending before any other Court.

Perused the case diary provided by the learned counsel for the State in connection with Crime No.09/2018 registered at Police Station- Piperchedi, DistrictGariyaband (C.G.) for the offence punishable under Section 395 of Indian Penal Code.

Case of the prosecution, in brief is that on 12.11.2018, at about 9 am complainants Sadaram and Meghnath Sahu were returning back after leaving their children at Jawahar Navoday Vidyalaya, Mana Raipur. Near Berula Pull, applicant and other 7 unknown person reached there by motorcycle, beat complainants by hands and fists, threatened to kill them and looted Rs.550/-, one Samsung mobile, Votor ID card from complainant Sadaram and also looted Rs.700/-, Votor ID card from complainant Meghnath Sahu. During test identification parade, complainants identified the applicant.

Learned counsel for the applicant aruged that the applicant is innocent and has been falsely implicated hence he be released on bail. 5.

On the other hand, learned counsel for the State 3 other criminal cases under the IPC have been registered against the applicant. 6.

This Court has released on bail coaccused Deepak Vaishnav on 27/02/2019 in MCRC No.1375/2019 the true copy of said order is part of the bail petition. The case of applicant is not more severe then the coaccused Deepak Vaishnav who has been already released on bail by this Court. Thus, it is ordered that if applicant furnishes two solvent sureties for a sum of Rs.25,000/- along with a personal bond of Rs.50,000/- to the satisfaction of the concerned Trial Court with the condition that that he will appear before the Trial Court at 11:00 am as and when directed till trial and he would cooperate during the trial, he shall not involve himself in similar type of crime in future, he shall be released on bail. 7.
