1. Heard on the application filed under Section 439 of the Cr.P.C. This is first bail application before this Court filed by the applicant for grant of regular bail. The applicant has been arrested on 14.02.2020 in connection with Crime No.418/2019, registered at Police Station- TildaNavra, District- Raipur, C.G. for offence punishable under Sections 376, 363, 366 of I.P.C. and Sections 4 & 6 of POCSO Act, 2012.

2. It is submitted by the learned counsel for the applicant that there is no case made out against the applicant. The prosecutrix has given favourable statement under Section 164 of Cr.P.C. and further the parents of the prosecutrix have also given affidavit before the Sessions Court that they have no objection in grant of bail to the applicant. Therefore, it is prayed that he may be granted bail.

3. Learned counsel for the State/non-applicant formally opposes the

4. Heard learned counsel for the parties and perused the case diary.

5. According to prosecution case, the minor prosecutrix of age about 17 years and 03 months was abducted and sexually exploited by this applicant regarding which F.I.R. has been lodged.

6. After considering the submissions made by the counsel and the statement given by the prosecutrix before the Magistrate under Section 164 of Cr.P.C., I am of this view that this is a fit case for grant of regular bail to the applicant.

7. Consequently, this application filed by the applicant under Section 439 of the Cr.P.C. for grant of regular bail is hereby allowed. It is directed that the applicant shall be released on bail on his furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned Court, for his appearance as and when directed.
