(1) This is the second bail application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with Crime No.194/2014 registered at Police Station Durg, District Durg, for the offence punishable under Sections 363, 366, 376 of the I.P.C. and Section 8 of the Protection of Children from Sexual Offences Act, 2012.

(2) The applicant's first bail application was dismissed as withdrawn with liberty to file the same after examination of material prosecution witnesses by order of this Court dated 12.01.2015 passed in M.Cr.C. No. 6028/2014.

(3) After going through the record I do not find any material prosecution witnesses have been examined and, as such, there is no change in the circumstances in the case to entertain the second bail application in view of order dated 12.01.2015. (4) However, the applicant is free to file bail application after examination of the material prosecution witnesses as directed earlier.
